1. Agreement and eligibility
These Terms are an agreement between you and VENTURAL GLOBAL LIMITED ("OBEING," "we," "us"). By creating an account, placing an order or using the Services, you agree to these Terms and our Privacy Policy.
You must be legally able to enter this agreement and meet the minimum digital-consent age in your country. If you use the Services for an organization, you represent that you have authority to bind that organization.
2. Accounts and sign-in
Provide accurate information and keep your sign-in credentials secure. You are responsible for activity under your account and must notify us promptly about suspected unauthorized access.
You may sign in through a third-party provider such as Apple, Google or Facebook. Your use of that provider is also governed by its terms. You may request account deletion as described in the Privacy Policy.
3. Product orders and payment
Product pages and checkout show the item, currency, price, estimated taxes, shipping fees and expected fulfillment information before payment. An order is accepted only when we send an order confirmation. We may reject or cancel an order for availability, pricing errors, suspected fraud, export restrictions or other lawful reasons and will refund any amount charged for a cancelled order.
Payment is processed by third-party payment providers. You authorize the displayed amount and applicable taxes and fees to be charged to the selected payment method. Prices may vary by country and do not include import duties unless checkout expressly says otherwise.
Shipping is governed by our Shipping Policy. Hardware returns, refunds and warranty service are governed by our Returns & Refunds Policy and any non-waivable consumer rights in your country.
4. Software services and subscriptions
Some features require the OBEING app, a compatible phone, internet access or a paid plan. Features, language support and third-party integrations may vary by device, plan, market and software version.
If you purchase a recurring subscription, checkout will show the billing interval, price, trial terms if any, and renewal date before you confirm. Subscriptions renew until cancelled. You can cancel before the next renewal in the store or account setting through which you subscribed. Cancellation stops future charges and access continues through the paid period unless local law requires otherwise.
We may update software for security, reliability or compatibility and may modify or discontinue features. We will give reasonable notice when a material change adversely affects a paid service, except where urgent security, legal or technical reasons require faster action.
5. Responsible and lawful use
Do not use the Services to violate law, infringe rights, harass or deceive others, bypass safety measures, distribute malware, gain unauthorized access, or develop competing models through automated extraction. Do not rely on OBEING for emergency, medical, legal, financial or other high-stakes decisions.
Follow local laws about audio recording, notices, consent and use while driving. Do not interact with the display when doing so would be unsafe. OBEING One is not a protective, medical or safety-certified eyewear product unless expressly stated.
6. Your content and AI output
You retain ownership of content you submit. You grant OBEING a limited license to host, process and transmit that content only as needed to operate, secure and improve the Services as described in our Privacy Policy.
AI and translation output may be incomplete or inaccurate. Review important output before using or sharing it. Similar output may be generated for other users, and output may not be unique or protected by intellectual-property law.
You are responsible for having the rights and permissions needed for content you submit, including consent from participants when using meeting or recording features.
7. OBEING ownership and license
OBEING and its licensors own the Services, software, product design, trademarks and related materials. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable license to use the software with supported OBEING products.
You may not copy, sell, reverse engineer, circumvent access controls or create derivative works except where applicable law expressly permits and does not allow that restriction.
8. Suspension and termination
You may stop using the Services or delete your account at any time. We may suspend or terminate access when reasonably necessary to address a Terms violation, security threat, legal requirement, non-payment or risk of harm. When practical, we will give notice and an opportunity to resolve the issue.
Terms that by their nature should continue after termination, including ownership, disclaimers, liability limits and dispute terms, will survive.
9. Warranties and liability
Hardware may include a limited warranty described in our Returns & Refunds Policy. Consumer-protection laws may provide additional rights that these Terms do not limit.
To the extent permitted by law, digital Services are provided "as is" and "as available." We do not promise that they will be uninterrupted, error-free or suitable for every use. We exclude implied warranties only where the law permits.
To the extent permitted by law, OBEING is not liable for indirect, incidental, special, consequential or punitive damages, or loss of profits, data or opportunities. Our aggregate liability relating to the Services will not exceed the greater of the amount you paid OBEING for the relevant product or service in the prior 12 months or US$100. These limits do not apply where prohibited by law or to liability that cannot lawfully be limited.
10. General terms and contact
These Terms, the policies they incorporate and any order-specific terms form the complete agreement between you and OBEING. If a provision is unenforceable, the remaining provisions continue. A delay in enforcement is not a waiver. You may not transfer this agreement without our consent; we may transfer it as part of a reorganization, financing or sale of business.
The laws applicable in the jurisdiction of the OBEING contracting entity shown on your order confirmation govern these Terms, without limiting mandatory consumer rights in your country. Courts or consumer dispute bodies with jurisdiction under applicable law may hear disputes.
We may update these Terms prospectively. If a material change affects an existing paid service, we will provide reasonable notice. Continued use after the effective date means you accept the updated Terms.
